Gambling, also called sports betting, is the wagering of something of worth or value on an occasion with an uncertain outcome with an acceptable probability. With gambling, therefore, there must be three components to be present: risk, consideration, and a payoff. When a player bets on a game, the stakes of the bet are referred to as wagers. In most provinces, there are some variations to the application of the law. For example, in British Columbia there is no requirement that lottery tickets are sold at a retail store, while most provinces require that retailers selling lottery tickets also maintain a revenue share with the Canadian Lottery Corporation (COC). In addition, even though gambling is considered to include video gambling, this has been ruled against in a few provinces.
As is the case with most other provinces, Ontario gambling laws do not differentiate between online gambling and land-based gambling. Therefore, if an individual is found to be gambling online, there may be additional fines involved. However, there are no charges levied in Ontario against individuals who are participating in online lottery games or who are conducting live gaming events. Individuals can obtain a copy of the Ontario gambling laws from the Ministry of the Attorney General. Individuals who are accused of gambling without a valid reason will have to fight their criminal charges head on, if they wish to defend their rights.
There are a few notable differences between Ontario’s gambling laws and those of other jurisdictions. Firstly, in most jurisdictions, it is illegal to operate a lottery that makes use of a computer or a bank account to withdraw money for your lottery ticket purchases. This is commonly referred to as a “lotto tax”. Although it is unlikely that such tax and penalty laws will change, it is good practice to be aware of these laws whenever you are considering purchasing lottery tickets. Secondly, most provinces have a mandatory age restriction for majority participation in certain gambling activities, including lottery tickets. Although this law is commonly referred to as a “minimum age requirement”, this is a more accurate representation of the situation.
